Know Your Rights: What to Do If ICE Approaches You at Home or Work

In today’s uncertain immigration climate, it’s more important than ever to know your rights, especially if you are approached by ICE (Immigration and Customs Enforcement) at home or at work. Staying calm and informed can make a big difference in how the situation plays out.

If ICE Comes to Your Home

If ICE agents come to your door, you do not have to open it unless they show you a warrant signed by a judge with your name and address on it. Ask them to slip the warrant under the door or show it through a window. A warrant signed by ICE alone (an administrative warrant) is not enough to legally enter your home.

You have the right to remain silent. You do not have to answer any questions about your immigration status, where you were born, or how you entered the U.S. Simply say, “I choose to remain silent,” and ask to speak to an attorney.

Never sign anything you don’t understand or feel pressured to sign. You have the right to legal advice before making any decision.

If ICE Approaches You at Work

At your workplace, ICE must also have a valid warrant to enter non-public areas. If you are questioned, remember: you still have the right to remain silent. Do not show false documents or lie, as this can seriously harm your case.

Employers are generally not required to allow ICE agents access to private areas without a judicial warrant. If you’re unsure of your employer’s policy, ask for clarification in advance or seek legal guidance.

Stay Prepared

Keep all your important documents and emergency contact information in a safe place. If possible, have a family emergency plan in case of detention, and share it with someone you trust.
